1. Project Agreement and Scope

All renovation and design work undertaken by Modish Home Makeover Ideas ("Company") is subject to a formal, written agreement defining the project scope, timeline, and cost. Any deviations from the agreed-upon scope (Change Orders) must be documented and approved by the client in writing.

2. Payment Schedule and Milestones

Payments are due according to the schedule outlined in the project agreement, typically tied to the completion and client sign-off of major project milestones (e.g., Demolition, Framing, Final Finish). Failure to make timely payments may result in project delays.

3. Client Responsibilities

The client is responsible for providing timely decisions on material selections, ensuring site access for the work crew, and securing personal valuables during the construction period. Delays caused by late client decisions may result in timeline extensions.

4. Warranties and Guarantees

The Company warrants its workmanship for a period of one (1) year from the date of substantial completion. Product and appliance warranties are covered by the respective manufacturer's terms. Our separate Home Warranty service may be purchased for extended protection.

5. Limitation of Liability

The Company shall not be liable for any indirect, incidental, or consequential damages arising from the project, including but not limited to delays, cost overruns, or property damage not caused by gross negligence or willful misconduct.

6. Site Safety and Access

Clients must ensure the worksite is safe and accessible. The Company is not responsible for injuries to unauthorized persons entering the project site. Pets should be secured, and hazards must be communicated to the project manager.

7. Material Availability

While the Company strives to source all materials as specified, occasional substitutions may be required due to supply constraints. All substitutions will be approved by the client before implementation.

8. Change Orders

Any modifications to the original project scope must be requested in writing. Change orders may affect the overall cost and timeline and require client approval before work proceeds.

9. Delays and Force Majeure

The Company is not responsible for delays caused by events beyond its control, including natural disasters, strikes, or supply chain interruptions. In such cases, the project timeline may be extended accordingly.

10. Termination

Either party may terminate the agreement in writing if there is a material breach of the terms. Payments for completed work up to the termination date will remain due, and the client may be responsible for any costs incurred as a result of the termination.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

12. Dispute Resolution

Any disputes arising from the project will first be attempted to be resolved through informal negotiation. If unresolved, disputes may be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
